1. The following terms have the following meanings in these conditions: “Farwells” means G Farwell Limited, “Purchaser” means the person, firm or company contracting with Farwells and “Skips” means skips.
2. These conditions apply to the hire of Skips by Farwells and the order includes the acceptance of these conditions subject to any variation by Farwells. These conditions and no others shall apply to all the orders and contracts for the hire of Skips.
3. Any date given by Farwells for delivery of the Skip is intended as an estimate only.
4. Unless otherwise agreed Farwells may collect the Skip at any time after the expiration of 14 days from delivery.
5. For account customers, payments are to be made 30 days after the date of invoice and if appropriate Farwells reserves the right to invoke the terms of Late Payment of Commercial Debts (Interest) Act 1998 on all overdue accounts. For all other Purchasers payments are to be made at the date of order or upon delivery of the Skip.
6. Purchasers ordering Skips for delivery off the public highway do so entirely at their own risk.
7. In respect of Skips and other waste transfer collections the Purchaser confirms that he has fulfilled his duty to apply the waste hierarchy as required by Regulation 12 of the Waste (England and Wales) Regulations 2011.
8. Farwells shall not be liable to the Purchaser or be deemed to be in breach of the Contract by reason of any delay in performing, or any failure to perform, any of Farwells obligations in relation to the Skips, if the delay or failure was due to any cause beyond Farwells reasonable control.

a. Except in respect of death or personal injury caused by Farwells’ negligence, Farwells shall not be liable to the Purchaser for loss of profit, revenue, contracts or business or any indirect or consequential loss whether arising from negligence, breach of contract or howsoever.
b. Farwells liability in respect of loss of or damage to any tangible property shall not exceed £5,000,000 in respect of each event or series of connected events.
c. Except in respect of liability for loss of or damage to property as referred to in b. above, the aggregate liability of Farwells in respect of all claims arising out of or in connection with any contract for the hire of Skips shall not exceed the price payable by the Purchaser under that contract.
10. Farwells accept no liability for injuries, expenses or damages caused by incorrect, faulty or improper use of Skips by the Purchaser. The Purchaser undertakes to use the Skips in accordance with Farwells instructions and conveyance note in condition
11. The purchaser will be required to sign the conveyance/waste transfer note from Farwells which states as follows:
“Skips must not be moved on site, hire is STRICTLY for 14 days (including weekends), unless notified otherwise.
Customers or persons requesting the company, its agents or employees to leave the road when delivering or collecting goods or containers will accept full responsibility in respect of any loss, claim, damage or expense incurred as result of any damage caused to road markings, pavements, driveways, tarmac, buildings, walls, fences, hedges, gates, posts, overhead wires, manhole covers, underground services, animals, or any other fabric items or chattels damaged due to such a request.The following must not be placed in the skips under any circumstances: Asbestos (in any form), fibrous material that resembles asbestos, plasterboard, mattresses, sofas/armchairs/padded foam seats, tyres, liquid containers/drums/ barrels/ cartons (even if empty), liquids, liquid paint, lead acid /vehicle batteries, gas cylinders, fridges/freezers, televisions, computer monitors, microwaves, fluorescent tubes, any form of special, difficult or hazardous waste, anything that is predominantly dust, food waste, or any odorous waste, and any flammable materials. Plasterboard must be segregated from other waste in the skip by bagging it and then placing on top of the other waste when the skip is filled so it can be easily lifted off before tipping the remaining waste.
The skip must be loaded level with the sides, not heaped. Overload charges are applicable if this guidance is not followed.
Fires are strictly forbidden in the skip, the customer or persons hiring the skip takes full responsibility for any reparation cost to the skip in the case of fire/arson.”
12. The laws of England shall govern these conditions and every contract incorporating them.
Overloaded Skips
We can collect
Skips that are filled level with the top edge, with no items overhanging the sides and the load safe for transport.
We cannot collect
Skips that are overloaded, have waste above the top edge, contain overhanging items or have an unsafe load.

We kindly ask that you respect our drivers by keeping your skip loaded to an acceptable level.
It is their driving licence on the line if they transport an unsafe load on the public highway.
Overloaded skips cannot be collected and will be left for you to remove the excess waste before collection can take place.
We understand that you want to get the most from your skip, but we must comply with UK transport regulations to ensure the safety of our drivers and other road users.
